Pre Meet and Confer - What You Need to Know and Why
Within 90 days of the filing of suit, both sides will need to sit down with their clients and determine how much data they have and is any of it applicable to the matter at hand. The problem lies in the ability, or inability, of the biased client who may be trying to hide something, or has just forgotten after several years. Thankfully, what your client may have forgotten, we can get back. Let one of our attorneys sit down with you to go over your strategic meet and confer plan.
Under the new amended rule set, you need to know where your client's data is and how to access it. Don't wait until opposing counsel deposes your client, or a member of your client's IT staff, to show you were that data resides.
Performing due diligence now means taking action in the digital world proactively...not reactively.
